AN ORDINANCE CREATING LOCAL IMPROVEMENT DISTRICT NO. 79 OF THE CITY AND BOROUGH; FINDING THAT SUCH LOCAL IMPROVEMENT DISTRICT IS IN THE PUBLIC INTEREST; SETTING THE BOUNDARIES OF SUCH LOCAL IMPROVEMENT DISTRICT; PROVIDING FOR THE IMPROVEMENTS TO BE ACQUIRED, CONSTRUCTED AND INSTALLED CONSISTING OF IMPROVING THE SEWER FACILITIES, SUBBASE DRAINAGE, AND PAVING OF TREADWELL STREET, SUMMERS STREET, "D" STREET, "E" STREET, "G" STREET, AND FIFTH STREET, ALL IN DOUGLAS, AT AN ESTIMATED COST OF $1,600,000 OF WHICH COST AN ESTIMATED $257,400 IS TO BE BORNE BY PROPERTIES SPECIALLY BENEFITTED AND AN ESTIMATED $1,342,600 BY THE CITY AND BOROUGH; DIRECTING THAT THE WORK BE DONE, AUTHORIZING ACQUISITION, BY EMINENT DOMAIN, IF NECESSARY, OF ANY LAND NECESSARY OR USEFUL; CREATING SPECIAL ASSESSMENT FUND NO. 79; AND FINDING THAT SPECIAL BENEFIT TO THE PROPERTY WITHIN THE DESCRIBED DISTRICT EXISTS AND THAT EACH LOT OR TRACT WITHIN THE DISTRICT WILL BE SPECIALLY BENEFITTED IN PROPORTION TO THE AMOUNT ASSESSED. 1. Ordinance No. 95-26

AN ORDINANCE AUTHORIZING THE NEGOTIATED SALE OF APPROXIMATELY 10,350 SQUARE FEET OF MUNICIPAL LAND LOCATED ALONG EVERGREEN AVENUE TO DON AND MARJORIE SCHMIEGE AND SETTING FORTH TERMS, CONDITIONS AND OTHER MATTERS RELATED TO THE SALE. Presented by the Manager.

2. Ordinance No. 95-27

AN ORDINANCE AMENDING THE PLANNING AND ZONING CODE RELATING TO COMMON WALL SUBDIVISION APPROVALS, VICINITY MAP SCALING, THE METHOD FOR MEASURING COMPLIANCE WITH LOT DIMENSIONAL STANDARDS IN CERTAIN CIRCUMSTANCES, INSTALLATION OF SUBDIVISION STREET SIGNS AND PAVEMENT MARKINGS, MINOR STREET AND MARGINAL ACCESS WIDTHS, PROCEDURES FOR NAMING STREETS, MINIMUM CUL-DE-SAC STREET LENGTHS, AND DRAINAGE SYSTEM REQUIREMENTS. 3. Ordinance No. 95-11 (F)

AN ORDINANCE APPROPRIATING TO THE MANAGER THE SUM OF $4,405 FOR UNDERGROUND STORAGE TANK TIGHTNESS TESTING. SUCH FUNDS PROVIDED BY THE ALASKA DEPARTMENT OF ENVIRONMENTAL CONSERVATION. Presented by the Manager.

4. Ordinance No. 95-11 (G)

AN ORDINANCE APPROPRIATING TO THE MANAGER THE SUM OF $1,200,000 FOR CONSTRUCTION OF A WATER LINE FROM THE TERMINUS OF THE CURRENT SYSTEM AT NORTH LENA TO TEE HARBOR. SUCH FUNDS PROVIDED BY THE WATER EXTENSION FUND. Presented by the Manager.

B. Resolutions:

1. Resolution No. 1774

A RESOLUTION AMENDING RESOLUTION NO. 1761 LOWERING THE INTEREST RATE CHARGED TO PROPERTY OWNERS FOR L.I.D. AND CORRECTING AN ADMINISTRATIVE ERROR IN THE ASSESSMENT ROLL. Presented by the Manager.

2. Resolution No. 1775

A RESOLUTION AUTHORIZING THE MANAGER TO EXPEND $50,000 FROM FUNDS PREVIOUSLY APPROPRIATED TO THE ALASKA COMMITTEE, SUCH EXPENDITURE FOR THE PURPOSE OF AN ANEMOMETER AT EAGLECREST FOR THE PURPOSE OF INCREASING AIR TRAFFIC SAFETY AND IMPROVING CAPITAL CITY ACCESS. Presented by the Manager.

C. Transfer Request:

1. T-571: Transfers $300,000 from Mendenhall Valley Paving LID 77 (CIP R412-26) and $500,000 from LID Paving and Dust Control (CIP R412-39) for a total transfer of $800,000 to Fifth Street Douglas Paving (CIP R412-48).

AN ORDINANCE AMENDING THE FOR-HIRE VEHICLE CODE TO DEFINE CERTIFICATES FOR BUSES AS APPLICABLE TO "ROUTED BUS OPERATIONS," TO LIMIT THE NUMBER OF VEHICLES THAT MAY BE AUTHORIZED BY A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY, TO PROVIDE PROCEDURES FOR AMENDMENT OF A CERTIFICATE BY THE CLERK, TO CHANGE THE CERTIFICATE TERM RENEWAL DATE, TO REQUIRE A CONSISTENT COLOR SCHEME AND DESIGN FOR ALL VEHICLES OPERATING UNDER THE SAME CERTIFICATE, AND TO MODIFY THE PROFESSIONAL DRIVER'S PERMIT REQUIREMENT SECTION; AND AMENDING THE PLANNING AND ZONING CODE TO EXEMPT PUBLIC VEHICLES FROM PROVISIONS RELATING TO OFF-PREMISES SIGNAGE. SUCH FUNDS PROVIDED BY $14,917 IN RETAINED EARNINGS FROM THE SALE OF DONATED STOCK, $764 IN RETAINED EARNINGS FROM STOCK DIVIDENDS, AND $710 IN RETAINED EARNINGS FROM UNRESTRICTED CONTRIBUTIONS.
